What determines who has custody of a child?
Custody decisions are to be made based on the child's best interests. That being said, mothers are historically granted custody more often than fathers. However, there are some exceptions.
The majority of the time there are arrangements. The most common is one in which one parent has sole physical custody, both parents have legal custody, and the noncustodial parent is granted visitation time.
Why would parents involved in a child custody case need a lawyer?
1.- An attorney will defend you in mediation and disputes involving your children, and ensures you are the primary caregiver for your child after a separation or divorce.
2.- Guide you through the paperwork.
3.- Represent you in court if you reach that stage.
Representing yourself in court is his right and may have pros and cons. However, going to court generally means that parents cannot find a solution.
